These regulations have been created for the purpose of cooperation between the Photographer and the Client (any person using my services). They are the result of my professional experience and common pre-session inquiries. I highly encourage you to review my portfolio before booking. Every Client receives a link to these regulations before the session and is obliged to read them. Booking a session is equivalent to accepting these Terms & Conditions.
1. Artistic Style and Post-Production
By accepting these terms, the Client declares they are familiar with the Photographer’s portfolio and accepts the style, color palette, post-production effects, and general aesthetics of the work, as well as the Photographer’s artistic interpretation.
- The Photographer uses Lightroom for selection and post-production.
- The Photographer does not use Photoshop for retouching (which means, among other things, no skin smoothing, removal of birthmarks, etc.).
- The Client agrees not to interfere with the graphic editing techniques used by the Photographer.
- A „photo session” is defined as the execution of a series of photos and their subsequent graphic processing.
2. Professionalism and Equipment
The Photographer ensures they possess the necessary skills and experience. The work is a result of creative activity free from legal defects. The Photographer also declares they use professional equipment suitable for the session.
3. Booking and Payments
- The session date and details are determined individually.
- After confirming the date, a deposit (retainer) of 200 PLN must be paid to the Photographer’s bank account.
- The remaining balance must be paid via bank transfer no later than the day of the session.
4. Personal Data (GDPR)
To perform the session and maintain contact, the following data is required: name, surname, email address, and phone number (optionally, home address). Details regarding data processing are provided in the GDPR Information Clause shared before the session.
5. Punctuality and Travel
- Clients must arrive on time. In case of a delay, the late time may be deducted from the total session time (especially during „mini sessions” scheduled back-to-back).
- For lifestyle sessions, the Photographer travels to the Client within Warsaw and its surrounding areas. Further locations require prior confirmation and an additional travel fee.
6. Packages and Additional Orders
- The Client selects a package according to the current offer before the session.
- After the session, the package can be upgraded but not downgraded.
- Additional edited photos, prints, or albums (storybooks) can be purchased for any package.
7. Rescheduling
- The Client may reschedule the session twice due to unforeseen circumstances, illness, or poor weather, provided they notify the Photographer at least two hours before the start.
- The Photographer also reserves the right to reschedule twice without consequences.
8. Additional Costs and Liability
- Any entry fees for specific locations (e.g., parks, private venues) are covered by the Client.
- The Client is responsible for any damage or loss of the Photographer’s equipment caused by the Client or their party during the session.
9. Deadlines and Delivery
- Selection: Within 10 business days after the session, the Photographer sends a gallery of low-resolution watermarked images for the Client to choose from.
- Final Delivery: Within 20 business days from the moment the Client makes their selection (and pays for any extras), the final edited high-resolution files (min. 5000px on the long side) will be available for download.
- Prints: Physical prints/albums will be ready for pickup or shipping via InPost (additional fee of 20 PLN).
- The Photographer reserves the right to extend these deadlines in case of illness, vacation, or emergencies.
10. Copyright and Usage
- All photos are „works” under Copyright Law. The Photographer retains all intellectual and proprietary copyrights.
- Personal Use: The Client is entitled to use the photos for non-commercial personal use (printing for personal needs, sharing with family/friends).
- Prohibitions: Without prior consent, it is forbidden to edit, crop, apply filters, or alter the colors of the photos.
- Online Sharing: The Photographer grants a license for non-commercial online sharing (social media, personal websites). The Client agrees to credit the Photographer as Gazdowanie Fotografia with a link to the website.
- Commercial Use: Requires written consent and may involve an additional fee.
11. Portfolio and Image Consent
- For „portfolio sessions” (unpaid/TFP), withdrawing consent for image publication requires the Client to pay the full price of a standard package.
- The Photographer always asks for consent to publish the Client’s image after the final photos are delivered.
- Consent may be withdrawn at any time in accordance with GDPR.
12. Final Provisions
- The Photographer is not obligated to archive unselected or final photos after delivery.
- Lifestyle sessions use natural light only; the Photographer does not bring studio backdrops or lighting.
- The final result depends on factors like weather, the models’ mood, and available light.
- Gift Vouchers: Valid for 6 months from the date of issue. Non-refundable and must be paid in full upfront.
